MediaBrains is committed to protecting and respecting your privacy. This Privacy Policy (the “Privacy Policy”) explains how we collect, use, process and transfer information that we obtain about visitors to the MediaBrains website and its directory websites owned and controlled by MediaBrains Inc. (collectively, the “Site” or “Sites”) and the services available through the Sites (collectively, the “Services”). The terms ‘we’, ‘us’, or ‘MediaBrains’ are each intended as reference to MediaBrains Inc. For users accessing the Sites from the European Union, MediaBrains is the data controller for the processing of personal information under applicable law.

This Privacy Policy describes how MediaBrains collects, uses, processes, transfers and secures the personal information that you provide, and it also describes your choices regarding use, access and correction of your personal information. For purposes of this Privacy Policy, personal information shall mean any information relating to an identified or identifiable natural person. This Privacy Policy applies only to information that we collect, process and use within the Sites and does not apply to any third-party Web sites to which the Sites may link to. Please note that your use of the Sites is also governed by our Terms of Use Agreement.

  1. Information that we collect.

    We collect information about you to provide our Services. The types of information that we collect while you use the Sites are described below and include both information that you provide to us and information that we collect automatically when you use the Sites.

    1. Information You Provide

      In the course of providing our Services, the type of personal information we collect or receive depends on how you use our Site and Services. You are not required to provide any information to access our Site and review portions of our directory content. However, to receive full access to our directory content, to list a business in our directory or to purchase advertising, you will be asked to register and provide additional information (described below). The submission of this additional information is completely voluntary but is required to gain access to these additional Services.

      • Directory Site Access User Registration.                                    

        In order to gain full directory Site access, you must register with the Site. In creating a user registration, you need to provide us with the following information: name, email address, job function, company name and a password. When you register at our Site, we will use your email address as your username, along with the password you create to provide you access to associated services and materials. When you revisit our Site, this username and password will provide this same access to you – or to others you allow to use your login credentials. You should refrain from providing others with access to your account if you would prefer that they not access the "registration only" portions of our Sites with your password.

      • User Inquiry Submission.

        If you choose to submit a request for information from an advertiser, you must provide your name, email address, job function and company name.

      • New Company Submission.

        If you choose to register your company with our Site, you need to provide us with the following information: company name, website URL, company address, your name, your phone number and your email address.

      • Purchase of MediaBrains Advertising.

        If you choose to purchase advertising from MediaBrains, you will be required to enter into a separate agreement with MediaBrains relating to this purchase. You may provide us with additional information relating to your business in entering this contract. If you provide credit card information on the Site in connection with a purchase of advertising on our Site, that information is sent directly from your browser to a third-party service provider we use to manage our credit card processing and we do not store any credit card information on our servers.

      • Email and Other Direct Communications.

        You may email us or provide us with comments and feedback concerning the Sites generally. By communicating with us in these ways, you may provide us with your email address, and other personal information. We will handle information that you provide in this manner in accordance with our Privacy Policy for personal information.

    2. Information We Collect Automatically

      When you use the Sites, we automatically collect certain information (described below), including technical information about browser type, areas of the Site visited, date and time of access, host or service provided information, and identification of the referring site.

      • IP Address:

        We may record the Internet Protocol (“IP”) address of your computer or other electronic device when you visit the Sites. An IP address identifies the electronic devices you use to access the Sites, which allows us to maintain communication with you as you navigate through the Sites. We also may use your IP address to provide you with personalized content.

      • Cookies

        Our Sites use cookies and similar Internet technologies to learn more about your use of our Sites in an effort to improve our Services. "Cookies" are small text files that a web site can use to recognize repeat users, to facilitate the user's ongoing access to and use of a site, and to compile aggregate data to improve a site and focus advertising. Cookies work as follows: a web site will send a cookie to your browser that uniquely associates your computer with information stored at the site. Your browser places the cookie in its cookies file. When you next access that site on your computer, the site recognizes the cookie, makes the stored information available, and adds new information based on the present visit. If you agree to this Privacy Policy and our Terms of Service, you are consenting to the use of cookies. This consent can be revoked at any time by disabling cookies, as discussed below.

        • Disabling Cookies

          You may choose not to allow us to collect information in this manner, through cookies. If you wish, you can set your browser software to reject cookies, and most browsers provide instructions for disabling the cookies feature in their "Help" section. Because cookies can be used to provide certain functionality, if you disable your browser's cookies feature, certain elements of the Sites may be unavailable to you.

      • Advertisers' Collection of Information

        With Internet technology, it is possible for advertisers, as well as site hosts, to collect information through the use of cookies and other technologies, such as so-called "clear GIF" files.

      • Information Collected from Other Sources

        We may combine information about you from a visit to one of the MediaBrains Sites with information about you from visits to another MediaBrains Site. We may also combine information about you that we collect from our Sites with information we have collected from offline sources, as well as with information provided to us by third parties.

  2. How We Use Your Information

    We have a legitimate interest to use the information we collect to provide you the Services you request, communicate with you, improve your experience on our Sites, generally improve our product offerings and Services, security of our Sites and your information, and for other internal business and administrative purposes. These uses may include the recording, storage, alteration, retrieval, use, disclosure by transmission, dissemination or otherwise making available, restriction, erasure or destruction of personal information. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy. In most cases, it may not be possible for us to specify in advance the periods for which your personal information will be retained.

    When you register to gain access to our Sites, the personal information that you provide will be used to deliver the Service you requested, such as company or product information or whitepaper downloads from our Site advertisers. We may also use the information you provide to send you relevant e-newsletters from our Sites. You may opt-out from receiving these e-newsletters at any time by contacting MediaBrains below or using the unsubscribe mechanism included with the e-newsletter.

    When you browse our Sites, the choices you make may provide information concerning your interests, and the appeal and efficacy of associated Site features. This information will be used to improve our Services. This information may also be used to identify e-newsletters, product information or whitepapers about which you might be interested in receiving additional information.

    When you register your company with MediaBrains, this information may be made available to the public as a listing in our Sites. This information may also be made available to a user to whom you send a reply to a request for more information. The information also may be used to communicate with you regarding your account(s) with MediaBrains. We also use your email address to respond to incoming service and support requests from you, communicate with you regarding advertising invoices and payment remittances, to collect customer feedback and to send other service informational and marketing emails. We may ask for your postal address because some of our services require a mailing address so that we can perform the service completely. For example, we need your postal address for credit card validation.

    We may share information with publishing partners, which are not part of MediaBrains, for the purpose of including your information in print directories. The information shared with these publishing partners may include your company’s name and contact information. However, MediaBrains will not share your password to any third party. These companies and organizations may also use the information we share to provide special opportunities and offers to you.

    Except as otherwise provided in this Privacy Policy, we will keep your personal and financial information private and will not share it with third parties, unless such disclosure is necessary to: (a) conform to the edicts of the law or comply with legal process served on MediaBrains or its Sites; (b) protect or defend the rights or property of MediaBrains, its Sites or its web site users or (c) enforce our terms of service.

    We may also disclose your personal information to any successor-in-interest such as a company that acquires us. In the event we enter into a business transaction, merger or acquisition by or with another company, or sale of all or a portion of our assets, your personal information will likely be among the assets transferred.

  3. Consent
    • User Registration Site access registration also requires you to agree to this Privacy Policy by clicking “Sign up” on the registration page. By clicking “Sign up”, you are consenting to MediaBrains collecting, processing, and sharing your personal information as described in this Privacy Policy and in any other documents referenced in this Privacy Policy. If you connect to our Site using LinkedIn we will receive information that you authorize LinkedIn to share with us, which may include public information, birthday, current city work, school and email address. When we receive this information, it becomes MediaBrains account information for purposes of your use of the Site. This information also constitutes personal information and will be subject to this Privacy Policy. You have the ability to disconnect your LinkedIn account from your MediaBrains account by changing your privacy settings in your LinkedIn account. You may withdraw your consent at any time by contacting MediaBrains as described below. Withdrawing your consent will not affect the lawfulness of processing by MediaBrains prior to the withdrawal of the consent or pursuant to another legal basis.

    • Company Registration Site access registration also requires you to agree to this Privacy Policy by clicking “Sign up” on the registration page. By clicking “Sign up”, you are consenting to MediaBrains collecting, processing, and sharing your personal information as described in this Privacy Policy and in any other documents referenced in this Privacy Policy. If you connect to our Site using LinkedIn we will receive information that you authorize LinkedIn to share with us, which may include public information, birthday, current city work, school and email address. When we receive this information, it becomes MediaBrains account information for purposes of your use of the Site.     • Cookies By registering to use the Sites either as a company or as a user, you consent to the use of Cookies as described herein. Further, if you continue to use the Site without disabling Cookies, after receiving notice that the Site uses Cookies, it will be understood that you agree to the use of Cookies as set forth herein. You may withdraw your consent at any time by contacting MediaBrains as described below. Withdrawing your consent will not affect the lawfulness of processing by MediaBrains prior to the withdrawal of the consent or pursuant to another legal basis.

  4. European Union Resident Rights

    If you are accessing the Sites from the European Union, you have the following data protection rights:

    • You may access, correct, update or request deletion of your personal information at any time by contacting us using the contact details provided under the “Contact Information” section below.

    • You may object to MediaBrains processing your personal information, ask us to restrict processing of your personal information or request portability of your personal information. You can exercise these rights by contacting using the contact details below.

    • You have the right opt-out of any marketing communications we send to you at any time. You may exercise this right by clicking on the “Unsubscribe” link in the marketing emails that we send to you. Or you may reply to any of our marketing emails requesting to be removed from our email database.

    • If we have previously collected and processed your personal information with your consent, you can withdraw this consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

    • You have the right to complain to a data protection authority about our collection and use of your personal information. For more information, contact your local data protection authority.

    We will respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable laws. We reserve the right to keep any information in our archives that we deem necessary to comply with our legal obligations.

  5. Security

    We employ physical, electronic and managerial measure to safeguard the information we collect online. While no company can fully eliminate all security risks, we cannot make guarantees about any part of our Services. You are responsible for keeping your username and password secure and secret.

  6. Accessing our Sites Globally

    The Sites are owned and operated by MediaBrains in the United States and all information collected, stored or otherwise processed by MediaBrains is done in the United States. If you are visiting any of our Sites from a country outside of the United States, your communication with us will necessarily result in the transfer of information across international borders to the United States and you acknowledge and consent to this transfer. By using our Sites, you understand and agree that your personal information will be stored and processed in the United States in a manner consistent with the terms of this Privacy Policy.

  7. Changes to our Privacy Policy

    We may modify this Privacy Policy at any time, but we will provide prominent advance notice of any material changes to this Privacy Policy by posting a notice on our Sites or sending you an email, to provide you with the opportunity to review the changes and choose whether to continue using the Services.

  8. Privacy Protection for Children

    Our Sites are not directed at children, and we will not accept or request personal information from individuals we know to be under 16. If we learn that a child under 16 has provided us with personal information, we will delete this information from our databases.
